PLEASE READ THESE TERMS AND CONDITIONS IN THEIR ENTIRETY
1.1. MWEB GameZone offers an Internet destination where participants can receive news and information about gaming, advice, gaming connectivity and compete in game tournaments. These general Terms and Conditions contained herein regulate your usage of the GameZone site and your participation in such tournaments. By registering for an account on GameZone and by registering as a player to participate in any tournament you confirm your acceptance of and agreement to be bound by the then most current version of these general Terms and Conditions which can be accessed on the GameZone and Tournament Sites ("the Sites"). MWEB reserves the right to change these general Terms and Conditions at any time, without advance notice. You are responsible for reviewing these general Terms and Conditions regularly for any changes. By your continued use of the Sites including such changes you accept the then current general Terms and Conditions, which include tournament rules, eligibility, disqualification, acceptable participation behaviour, disqualification etc.
1.2. Additional terms may apply to specific tournaments. We will post these terms on the Tournament Site for each specific tournament and they are incorporated by reference into these general Terms and Conditions. In the event of any conflict between these general Terms and Conditions and any additional terms that apply to a specific tournament, the additional terms will take preference.
1.3. By accepting these general Terms and Conditions you further confirm your knowledge that these Sites are regulated and administered by MWEB. The GameZone tournaments are managed, monitored and refereed by a Tournament Administrator. You acknowledge before participating in any specific tournament that you accept that any decisions of the Tournament Administrator regarding a specific tournament are final and binding on you and all participants and that MWEB and/or the Tournament Administrator are solely responsible for final decision-making and adjudication in all circumstances.
1.4. MWEB RESERVES THE RIGHT TO IMMEDIATELY SUSPEND AND/OR TERMINATE YOUR ACCESS TO YOUR ACCOUNT AND/OR DISQUALIFY YOU FROM A TOURNAMENT IF YOU VIOLATE, OR IF MWEB REASONABLY BELIEVES YOU MAY BE OR WILL BE VIOLATING THESE GENERAL TERMS AND CONDITIONS OR SPECIFIC TOURNAMENT TERMS, AT ANY TIME WITHOUT NOTICE.
2.1. To open an account and/or participate in any tournament offered on the Sites, you must:
2.1.1. be a natural person, at least 18 (eighteen) years old and the email address, which you submitted when registering your account, must be assigned to you personally and be under your control;
2.1.2. be a lawful resident in and subject to the jurisdiction of the Republic of South Africa;
2.1.3. have provided all information required when registering on the Sites and for a specific tournament, which information you confirm is true, accurate, current and complete;
2.1.4. not be currently suspended from playing in a tournament on the Sites; and
2.1.5. not be an employee of MWEB or a direct family member (parents, siblings and children) or an employee of a sponsor, promoter, organiser or direct family member of the specific tournament.
2.2. Failure by you to comply with the eligibility criteria above, entitles MWEB to immediately cancel your access to your account and your participation in a tournament and you will forfeit any prizes or winnings to which you may have been entitled. You also consent to MWEB verifying your information at any time and if found, in MWEB's sole discretion, that your information is incorrect, false or inaccurate, MWEB may suspend or terminate your access to your account and participation in a tournament without notice and you will forfeit any prize to which you may be entitled.
3. PARTICIPATION CRITERIA
3.1. You may not register more than once to participate in a specific tournament however you may participate in separate tournaments running at the same time. Registration whereby you play as 2 (two) or more separate participants in a tournament is not permitted. In the event that MWEB discovers that you have registered as 2 (two) or more separate participants, MWEB reserves the right to immediately cancel your access to all your GameZone accounts and impose such further sanctions on you as it deems fit.
3.2. You, as the holder of the account, take full responsibility for the use of your account in compliance with these general Terms and Conditions and the terms of a specific tournament. Your account and all benefits accruing therefrom are not transferable to another person and all activities on your site and your participation in a specific tournament are accordingly deemed to have been in your name. It is your responsibility to prevent the use by another person of your account, access to your site, participation in any specific tournament and receipt of any prizes. BY REGISTERING ON THE SITES AND PARTICIPATING IN TOURNAMENTS YOU AGREE TO INDEMNIFY AND HOLD MWEB HARMLESS FROM ANY CLAIMS, LIABILITY, DAMAGES AND OR COSTS (INCLUDING ATTORNEY/CLIENT FEES) OF WHATSOEVER NATURE, INCLUDING INDIRECT AND CONSEQUENTIAL DAMAGES, ARISING FROM THE AFORESAID PROHIBITED USE BY ANY PERSON OTHER THAN YOU.
4. VIOLATIONS OF TERMS AND CONDITIONS AND MWEB POLICIES
4.2. Any violation by you of the above or failure to comply, will result in immediate action taken by MWEB, including account termination and blocking your site access, disqualification from any tournament current and in the future, the voiding of any prizes to which you may have been eligible and in the event of any illegal activity, disclosure to the appropriate authorities and legal action and blacklisting, in the sole discretion of MWEB.
5. GAMEZONE AND TOURNAMENT SITES RULES
5.1. MWEB accepts no responsibility for:
5.1.1. technical, hardware or software malfunctions, lost or unavailable network connections or computer online systems or disconnects from your tournament play on your platform;
5.1.2. registrations for tournaments that are not received for any reason or are late or incomplete thus not qualifying you to participate in or disqualifying you from a tournament;
5.1.3. the unavailability or inaccessibility of any of the Sites and/or the Internet, whether caused by disruption, downtime or traffic congestion of the Internet which affect the Sites;
5.1.4. unauthorised access to your Sites or accounts by other persons.
5.2. You may not:
5.2.1. gain unauthorized access to the Sites' systems or any account (other than lawful access to your own);
5.2.2. interfere with the communications, procedures or performance of the Sites or deliberately damage or undermine the Sites;
5.2.3. affect the outcome of your tournament game play on your platform by means of or with the assistance of macros, bots, automated programs, screen analysis utilities, player collusion, game stalling or any type of modifications, memory readers or similar methods, or to otherwise commit fraud in relation to the Sites;
5.2.4. alter the human skill component of any game played on your platform in contravention of any specific tournament rules;
5.2.5. cheat, hack or otherwise alter the tournament games mechanics to receive an unfair advantage;
5.2.6. be abusive, profane, harassing, libelous, pornographic, sexually explicit or suggestive, racial, cultural or ethically offensive, intimidating, hateful or disorderly in your behaviour or communication during your participation in a tournament toward any other participant and/or the Tournament Administrator; and
5.2.7. collect, obtain, gather, transmit, compile, reproduce, delete, revise or display any material or information, whether personally identifiable or not, concerning any person, company or organisation, in connection with the use of the Sites, unless you have obtained the express written consent of such person, company or organisation to do so.
5.3. Any such transgression or attempt to do so will result in the termination of your access to your account, disqualifications from a tournament and/or further tournaments and forfeiture of all winnings to which you would otherwise be entitled.
5.4. The Tournament Administrator may, in his sole discretion, reserve the right to terminate any person's account and disqualify any person from a tournament or further access to the Sites, who is suspected of altering, manipulating or tampering with the game results for the tournament entered or any previous tournaments entered, or who otherwise violates the Site rules. If you are not certain whether certain conduct is allowed, please contact the Tournament Administrator.
YOU AGREE TO HOLD MWEB, ITS EMPLOYEES, OFFICERS, DIRECTORS, LICENSEES, AFFILIATES, SUBSIDIARIES AND HOLDING COMPANY, PROMOTION OR OTHER AGENCIES, ORGANIZERS, SPONSORS, ADVERTISERS AND AGENTS HARMLESS AND FULLY INDEMNIFY THEM FROM ANY LIABILITIES, LOSSES AND DAMAGES (INCLUDING CONSEQUENTIAL, INDIRECT AND SPECIAL DAMAGES) COST, EXPENSES, INJURIES TO YOUR PERSON OR DAMAGE TO YOUR PROPERTY OR DATA, OF WHATSOEVER NATURE THAT MAY ARISE AS A RESULT OF YOUR i) ENTRY AND USE OF THE SITES ii) USE OF ANY MATERIALS ON THE SITES iii) ENTRY AND PARTICIPATION IN A TOURNAMENT iv) BEHAVIOUR CONTRARY TO THE SITE RULES AND iv) THE ACCEPTANCE OF A PRIZE.
YOU FURTHER AGREE AND ACKNOWLEDGE THAT MWEB GIVES NO WARRANTY AS TO THE CONTENT OF THE SITES AND RELATED MATERIALS AND THAT USE THEREOF WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE.
7. CONSENT FOR PUBLICATION
You hereby consent that in using the Sites and partaking in tournaments, whether or not for promotion of MWEB and/or its sponsors, organisers or promoters, that MWEB and/or any sponsors, organisers or promoters may use, distribute, modify, adapt, reproduce, print, publish, publicly display and broadcast royalty free, worldwide, in any media, footage, recordings, modifications thereof at any time, your name, your tournament name, your picture, voice, likeness and/or biographical information for advertising, trade, exhibitions, promotional or related purposes and any other lawful purpose without additional compensation.
8. GENERAL TOURNAMENT RULES
8.1. To register for a tournament, certain information is required from the participant. The participant must log into the Tournament Site separately and provide the required information. Upon full completion thereof the player is required to register for a specific tournament. The tournament will have specific rules depending on the game that is being played. Players must read and understand these tournament rules. Failure to comply could lead to disqualification.
8.2. Specific tournaments are announced by a variety of methods such as by e-mail, private messages, social media, via the forum and other means.
8.3. Players can either play individually in a tournament or in a team, depending on the specific tournament. Where players partake in a tournament by playing in teams, players will either be allocated to a team by the Tournament Administrator or can choose to form part of a team formed for the specific tournament. Teams can announce their participation in a tournament and their elected team captain and register as such.
8.4. Tournament games will take place at specified locations or on–line at specific predetermined dates and times set by the Tournament Administrator or in some instances at dates and times as arranged between the team captains in which instance the team captain will advise the Tournament Administrator thereof accordingly.
8.5. Each separate tournament will allow a set number of players that may play per team, and normally substitutes are allowed in the event that one or more of the predetermined players in the team are unable to partake in a game at the specified date and time. The number of substitutes allowed depends on the specific tournament.
8.6. Where a team player is disqualified during a game or tournament or match, the substitute/s may not play in the place of the disqualified player and unless the team is disqualified as a whole, the team can elect to play at a disadvantage with the remaining players left on the team.
8.7. The teams will play against each other at set times and according to the specific tournament rules. Elimination of teams will either be by a single or double elimination process or by round robin, depending on the specific tournament being played and the rules of the specific tournament.
8.8. Quarter-finals, semi-finals and finals will either be played online or at designated sites. If any or all of these are played at a designated location, and a player is unable to play at such designated location, date or time, the substitute/s can play in the absent player's stead, alternatively the team will play with the number of remaining players at a disadvantage.
8.9. In instances where a player or a team wishes to dispute their scoring or that of other player/s or team/s, or the contravention by other player/s or team/s of the Site rules or the specific tournament rules including cheating, hacking or exploits, such player or the team must lodge a formal dispute with the Tournament Administrator. In addition the player/team must provide proof to the Tournament Administrator by providing screenshots or video recordings of the offending actions by the other player/s or team/s. The Tournament Administrator will review the dispute and accompanying proof and make a decision. The Tournament Administrator may disqualify a player/s or team/s, adjust the scoring or make any other decision appropriate to the specific dispute. Such decision will be final and binding on all players/teams partaking in the specific tournament.
8.10. In addition, games may be recorded by the Tournament Administrator and if the Tournament Administrator determines, in his sole discretion that teams or players have contravened the Site rules or the specific tournament rules, he may take any action as described in 8.9 above.
8.11. Each tournament will have a winning team. Team players may be eligible to receive prizes such as merchandise, cash, vouchers, codes for other games and the like. Not every tournament will award a prize to the winning team and the participants must refer to the separate rules for each individual tournament as to whether there will be a prize and the nature of the prize.
9. LICENSE TO USE THE SITES
MWEB hereby grants you a license to use the Sites only for the purpose of accessing, viewing or playing content and posting for your private, non-exclusive, non-assignable, non-transferable use and for no other purposes. The ownership of the contents of the Sites, material on the Sites, advertisements and the like remain the sole and exclusive property of MWEB and/or its licensees and advertisers. You may not alter, delete or conceal any copyright, trademark, service marks, trade names or other third party intellectual property on any material you download, transmit, display, print, record or reproduce from the Sites or allow another person to do so. Any unauthorised or prohibited action as aforesaid is strictly prohibited and you indemnify MWEB, its employees, officers, directors, licensees, affiliates, subsidiaries and holding company, promotion or other agencies, organizers, sponsors, advertisers and agents against any claim for losses or damages of whatsoever nature (including consequential damages and damages to your person or property) from any third person against your infringement of the license conditions and breach of third party intellectual property.
10. GOVERNING LAW AND JURISDICTION
The Sites are controlled by MWEB from its offices in the Republic of South Africa and MWEB makes no representation that the Sites are available from any other location outside of the Republic of South Africa. By making use of the Sites you subject yourself to the jurisdiction of the Republic of South Africa for the resolution of any dispute, difference, controversy or claim arising in connection with these general Terms and Conditions, any tournament and/or any prizes.
